    Shop and Establishment License (Shop Act License)

    The Labor Department of the state government governs the Shop and Establishment licenses. It is required for every new shop or establishment to get it registered under the Shops and Establishment Act. Businesses have to apply within 30 days from the commencement of the work.

    Background of Shop & Establishment License

    The Shops and Establishments Act is the law that every Indian state has passed to regulate working conditions and also to provide statutory obligations on the employer and rights of employees.

    Regulations under Shop & Establishment License

    Basic Fundamental Objective
    • To regulate the work conditions and
    • ensure the worker’s rights are protected businesses.

    It is an unquestionable requirement to register for a Shop & Establishment License to all kinds of businesses/freelancers, professionals, etc. It is mandatory enlistment for opening a current account or applying for a loan.

    Every shop and establishment must register within 30 days of starting work, regardless of whether it has employees or not. The Shop & Establishment certificate has to be displayed prominently in the shop/premise of business.

    Proprietors who wish to start or manage their business from home also require Shop & Establishment License.

    Renewal of License

    Every employer has to apply for a Renewal of license within 15 days of the expiry of the existing registration certificate.

    Records to be maintained

    All businesses need to request approval from the Labour Department and keep registers up to date regarding hiring, pay, credit reductions, fines, deduction and advances, salary, holidays under the said act. All details regarding annual holidays and the number of employees need to be submitted to the Labour Department every year.
